Childcare & Youth Programs

In this article, we'll help you by giving you an overview of what child care licensing looks like in New York. We will break down the licensing process in a way that will set you up for success. Read on to find out exactly what you need to get licensed so you can be on your way to opening a home daycare in New York City.

In New York, all child care programs fall under the state Office of Child and Family Services (OCFS). Within OCFS, there are several regional offices throughout the state. During the licensing process, you will work with the OCFS regional office that serves your region.

Home day care in New York is officially called Family Day Care. In addition to this, there are regular family daycare centers and family group daycare centers. What is the difference? Simply put, a regular family daycare can accommodate up to 6 out-of-school children and does not require you to hire an assistant.

However, a group home daycare requires you to submit an assistant with your application and you can have up to 12 children outside of school when your assistant is present.

Which one should you choose? It is up to you. If you have "enough" space for up to 12 children or you already have an assistant in mind, family group childcare is probably the best option for you. If you have a smaller space or prefer to do it alone, regular family daycare may be a better fit for you.

One last thing before we get to the requirements: Not sure if you actually need to get a license? Here's the OCFS rule: you must be licensed or registered if you plan to care for 3 or more children (not your own!) for more than 3 hours per day.

Okay, now that we've got the basics of what childcare is like in New York, let's move on to what it takes to get licensed to open a daycare.

Each of the above in isolation seems perfectly reasonable. But overall, there are many things for a prospective supplier to follow.

Child Care Resources

If you have at least 2 years experience as a parent or in paid/unpaid work with children, you qualify under OCFS. If you are only one year old, you can make up the extra year by completing 6 hours of training or early childhood development training. Note that if you hire an assistant, they must also meet this requirement.

When you receive your application, you also need to send in 3 references that can certify your experience in childcare. Your licensor will send them a form to complete and return. So you want to stay in touch with them throughout the application process to make sure they receive and return them promptly.

It is also very important if you rent from a landlord or management company or belong to an HOA that you make sure you have permission to open a home daycare before you do anything. We've seen people go through the licensing process, only to find out it's not allowed with their owner. Be sure to give them a thumbs up before continuing.

To initiate the licensing process, create an account on the OCFS website and follow their online orientation. It takes about 2 hours and you will watch a total of 20 videos. You can then apply for an official application. Once requested, your request will take approximately 1-2 weeks to arrive.

To run an accredited program, you must be current in first aid and pediatric CPR. But you do not need these certificates to submit your application. Instead, you only need to note in your application that you are certified. Also, make sure it's in person. Online courses in CPR and first aid do not count.

Once you have received your application and received your registration number (which will soon become your license number), you can register for your health and safety training through the training program website. early childhood (ECETP).

Health and Safety training is a 15 hour course, usually split into 2, 3 or 5 day sessions. There you will address in detail how you care for and ensure the health and safety of the children in your program. After completing the training, you will receive a certificate, which you must make a copy of and submit together with your application.

As a dependent, you must also prove that you are in good health and the application includes a form that you must take to your primary care doctor to sign. You will also need a tuberculin test and proof that you are negative.

Top Reasons To Consider Family Child Care

You must sign a form in front of a notary and have it stamped, stating whether you are currently obligated to pay child support or not. Some find it a bit of a curveball as it is hidden towards the end of the application package.

Then it is up to you as the applicant to ensure that each helper or member of your household has a clean criminal record before you submit your application.

For you and each household member listed on your application, you must complete a separate "Criminal Conviction Statement" form and a Personal Exclusion List (SEL) verification form. You must also register each household member on the Central State Registry (SCR) form and submit a $25 processing fee. Then, when you submit your application and your sponsor receives it, you and each member of your household must make an appointment to have your fingerprints taken.

Once you have submitted your application to your licensor and your fingerprints have been returned, your licensor will work with you to schedule 2 home inspections. The initial home inspection will focus on fire and safety, making sure your home is suitable and safe for childcare and that you have proper emergency plans in place.

Then you must have your final inspection. During this inspection, your licensor will verify all security requirements required by OCFS, proper equipment and supplies for your program, and documentation needed to maintain your program credentials. This visit usually takes about 2 hours, and making a good first impression is very valuable to your long-term relationship with your licensor.
